Detailed Description

The expert committee focuses on the civil law design of digital business models in the B2B and B2C area, in particular the design of contracts and terms of use for these business models and the respective digital content. In particular, the drafting of distribution contracts for digital content, for example data, as well as the drafting of contractual relationships between the various players in digital ecosystems, often centered on platforms such as Amazon, ebay, Alibaba, IoT platforms, Uber, AirBnB, etc., play a role here.

It deals with the specifics of the digital economy and platforms compared to the traditional economy and its traditional market players, in particular the roles and responsibilities of the different players, as well as the contractual and liability risks. In addition, the expert committee is dedicated to the special regulatory requirements, for example the P2B Regulation as well as  the Digital Markets Act and the Digital Services Act. It also focuses on antitrust regulations, such as Section 19a of the German Act Against Restraints of Competition (GWB), and competition law issues (unfair business practices), as well as regulatory requirements that apply in particular to certain industries, such as banking, insurance, and stock exchange regulations (e.g., Section 25b of the German Banking Act (KWG), MaRisk, BAIT, Section 5 of the German Stock Exchange Act (BörsG)).

Finally, the expert committee deals with specific tax framework conditions of the digital economy as well as the inclusion of international law enforcement and private international law.
